West Bengal RERA & Legal Verification Guide

Buying a Siliguri flat involves several separate checks: who can sell it, what has been approved, which project commitments are registered and whether the home can lawfully be occupied. Use WBRERA as one part of a document-led review. An attractive location, bank loan offer or promoter brochure cannot replace independent examination of the selected property.
Find the correct WBRERA project or phase
Search the official register using the project and promoter names, then record the registration number and land description. Match the registered phase to the tower, flat and facilities being offered. Review the declared delivery information and available project documents with your lawyer before paying a substantial amount.
The West Bengal Housing Department describes public access to project information and registered commitments. Use those records to ask precise questions about any difference between the registered details and the sales offer; preserve the documents and the date you checked them.
Review the seller's authority and title chain
Ask your lawyer to trace the title chain and check the seller's identity, development agreement or power of attorney where relevant, recorded interests and any disclosed financing. Clarify whether the transaction concerns freehold, leasehold or another tenure and what consents are needed for the particular transfer.
Mutation and tax receipts support a document review but should not be treated as a complete title opinion. Where the landowner and developer differ, establish who signs the agreement and deed, who receives each payment and who remains responsible for the promised construction and handover.
Check municipal and planning records separately
Establish the parcel's jurisdiction before deciding which approvals apply. SMC's building department lists site and building-plan documentation, including references to SJDA land-use compatibility and site-plan approvals. Check the actual sanctioned plan and any revisions against the flat, access, parking and common areas being sold.
An address described as Siliguri may fall outside the municipal boundary. Ask the competent authority or your lawyer to establish the requirements for that parcel. Avoid assuming that another project's approval process applies unchanged to your selected building.
Reconcile the agreement with the selected home
Check the area definition, unit identification, specifications, payment milestones, cancellation provisions, possession commitment and treatment of delay. Record parking rights and the facilities included in the registered phase. Ask for amendments to inconsistent descriptions before signing rather than relying on an informal assurance.
For resale, review the registered deed, prior agreements, association records and applicable lender releases. Obtain a written statement of dues and agree how any outstanding amounts will be settled. Keep payments traceable to the person or entity entitled to receive them.
Close the document gaps before handover
Request applicable completion and occupancy records, the final approved unit plan and the handover documentation. A physically finished flat and a legally complete handover are separate matters. Inspect the actual home and common services before recording that possession has been accepted.
If the promoter's current status differs from a portal listing, obtain an explanation supported by records. Ask your lawyer to identify unresolved issues, the evidence needed to resolve them and any payment that should wait. This checklist helps organise the review; the legal conclusion must relate to the specific property.
